PROTOCOL OF THE INTeR-PARLIAMENTARY COMMISSION ESTABLISHED UNDER RESOLUTION OF THE USSR SUPREME SOVIET’s COUNCIL OF NATIONALITIES OF APRIL 24 1991 ON PROPOSALS AIMED AT NORMALIZATION OF THE SITUATION IN THE SOUTH OSSETIA AND ITS NEIGHBORING AREA

The Inter-Parliamentary Commission of the Supreme Soviets of the USSR, RSFSR and the Republic of Georgia, with participation of the population of the conflict region,

pursuant to provisions of the Constitutions of the USSR, RSFSR and the Republic of Georgia recognizing the state sovereignty and territorial integrity of the Republic of Georgia, and in compliance with standards of international law recognizing the principle of non-interference in the internal affairs of a sovereign republic,

having familiarized itself with the situation on the ground,

believes that this conflict prevents the normal process of restoring Georgia’s independent statehood as expressed by the popular will at the referendum on March 31 1991; it is related to an attempt of certain forces to violate the Republic’s territorial integrity, and has a political origin.

With a view of normalizing the situation, ensuring the safety of the people, establishing peace and order, restoring economic activity and life sustenance of the population on the territory of the conflict region, the Intra-Parliamentary Commission believes it is necessary to:

1. Propose to the Supreme Soviet and the President of the Republic of Georgia to appeal to the population of the Republic, calling it to civil peace and conflict resolution by political means, based on a dialogue, in view of the Republic of Georgia Supreme Soviet’s Resolution of December 28 1990 ‘On Prohibition of Armed Units not Envisaged by Law’; in which to confirm exemption from liability for illegal storing or carrying of arms provided that the arms are voluntarily surrendered in the shortest terms; declaring guarantees of equal rights citizenship for the entire population of Georgia.

Call the confronting sides to stop using arms and other violent acts for the period of the conflict settlement.

2. For the period of normalizing the situation in the conflict zone, within two weeks, set up a Coordinating Committee at the Inter-Parliamentary Commission, on terms of parity, including representatives of the authorities of the Republic of Georgia and population of the conflict region. Its main objectives should include:

- Coordination of efforts of public authorities, government bodies and population in restoring economic activity and life sustenance of the region’s residents;

- Support to the commandant's office in the state of emergency zone for fully implementing the state of emergency regime;

- Support to the Georgian Ministry of Internal Affairs in re-establishing territorial police stations and in implementing their functions;

- Support to public authorities and government bodies in creating conditions for refugee return to places of their permanent residence, in solving the whole series of problems related to their transportation and accommodation, damage compensation, addressing legal issues, also for eliminating earthquake consequences;

- Creation of conditions for ending illegal acts of taking hostages and for setting them free, with assistance of the commandant's office in the state of emergency zone and law-enforcement bodies;

- Agreeing issues related to actions of internal troops contingent of the USSR MIA that ensure the state of emergency regime, beyond the state of emergency zone;

- Creation of conditions to solve issues and develop proposals on the structure of local authorities and government bodies on the territory of the former South-Ossetian Autonomous Area.

3. Define and change boundaries of the state of emergency zone by means of respective regulations of the Supreme Soviet and the President of the Republic of Georgia.

4. Ensure complete disarmament of all illegal armed units acting in the state of emergency zone, together with internal troops of the USSR MIA and respective territorial police stations of the Republic of Georgia MIA, and by means of the Republic of Georgia MIA.

Define the start date and the term for disarmament of illegal units and persons, also for voluntary surrender of arms.

5. Institute legal proceedings against persons who were engaged in violence, robberies and arsons, also those guilty of inflaming the ethnic conflict, regardless of their ethnicity and social status.

6. Use the experience of people’s diplomacy for the purposes of settling the situation in the conflict region, including participation of representatives of the elders, the intellectuals, public associations of citizens.

7. Set up an intelligence group at the Inter-Parliamentary Commission to generalize and analyze operative data received directly from the conflict region. Provide the group with a priority right to officially inform mass media about the situation in the conflict region.

8. Propose to the President of the USSR and the President of the Republic of Georgia to speed up the establishment of a Commission to negotiate resolution of a set of political, economic, social and other issues related to the restoration of the independent statehood of the Republic of Georgia, based on regulation of the Republic’s Supreme Soviet of April 9 1991, recognizing its right to independently solve the issue of accession to the treaty of alliance.

The Inter-Parliamentary Commission shall provide for field visits to the conflict zone to ensure permanent monitoring of the situation on the ground.
