PROTOCOL N 38 OF THE MEETING OF THE JOINT CONTROL COMMISSION (JCC) ON GEORGIAN-OSSETIAN CONFLICT RESOLUTION

Agenda:

1. Approval of the new JPKF Commander

2. Implementation of JCC’s earlier adopted decisions on ceasefire, withdrawal of illegal armed units, measures for further stabilization of the situation in the conflict zone

3. Preparation of a meeting between Z. Zhvania and E. Kokoity

4. Proposed increase in the number of OSCE observers in the conflict zone

Resolution:

1. Approval of the new JPKF Commander

 (Speakers: V. Evnevich, G. Khaindrava, B. Chochiev)

Having noted information from Lieutenant-General V. G. Evnevich, the sides decide as follows:

Major-General M. M. Kulakhmetov is appointed Commander of the Joint Peacekeeping Forces in the zone of the Georgian-Ossetian conflict.

2. Implementation of JCC’s earlier adopted decisions on ceasefire, withdrawal of illegal armed units, measures for further stabilization of the situation in the conflict zone

 (Speakers: M. Kulakhmetov, A. Kiknadze, K. Friev, R. Reeve, G. Khaindrava, B. Chochiev, T. Kusov, G. Kublashvili, L. Tibilov). Decision: (Annex 1).

3. Preparation of a meeting between Z. Zhvania and E. Kokoity

 (Speakers: G. Khaindrava, B. Chochiev, T. Kusov, L. Mironov)

The sides note the particular importance of the meeting between Z. Zhvania and E. Kokoity for further normalization of the situation in the zone of the Georgian-Ossetian conflict and for furthering the process of negotiations. The sides decide as follows:

With regard to the JCC’s call to the Russian and North Ossetian sides, to take note of the information of V. Kenyakin and T. Kusov about the work done for arranging the meeting.

4. Proposed increase in the number of OSCE observers in the conflict zone

 (Speakers: R. Reeve, B. Chochiev, G. Khaindrava, T. Kusov, L. Mironov)

The sides take note of the information of R. Reeve, Head of OSCE Mission to Georgia, about proposed increase of the number of OSCE observers in the conflict zone. The sides note that the issue concerning the increase in the number of OSCE military observers in the conflict zone should be addressed on the basis of agreements with the sides in conflict.

5. High-level JCC meeting

 (Speakers: L. Mironov, G. Khaindrava, T. Kusov, B. Chochiev, G. Gantchev)

The sides believe that a JCC meeting with high representation of the sides would be a useful step towards continuing negotiations on full-scale resolution of the conflict. Decision:

Further to the initiative of OSCE Chairman-in-Office S. Pasi, a high-level JCC meeting shall be held in Sofia or elsewhere as agreed with the sides, to be attended by the OSCE Chairman-in-Office.

 

6. Economic rehabilitation of the conflict zone

(Speakers: J. Vantom, B. Chochiev, G. Khaindrava, R. Reeve, Ò. Kusov)

Noting with satisfaction European Commission’s decision to allocate ˆ2,5 million for rehabilitation and development of economy in the area of the Georgian-Ossetian conflict and taking into consideration the unacceptability of further delay in implementation of projects under the Third Program of Economic Rehabilitation, the sides decide as follows:

1. The Organizational Committee to take necessary measures to launch and continue implementation of the agreed projects in the shortest terms;

2. The JCC to be informed about the progress at its next meeting.

7. Miscellaneous

1. With regard to the issue raised by the South Ossetian side and pertaining to the debt to Ugosetenergo for electrical power supplied to South Ossetian villages with prevailing Georgian population, the Georgian side is instructed to investigate on the issue of covering the dept before 15 September 2004 with a view to avoid discontinuation of power supply to these villages.

2. A. V. Jijoev and I. Loladze are approved as JCC newsletter coeditors from the South Ossetian and Georgian sides respectively.

3. The OSCE Mission is requested to launch funding of the JCC newsletter.

4. The date and venue of the next JCC meeting shall be decided on as the work proceeds.
