On socio-economic rehabilitation of the conflict zone (in view of the completed Needs Assessment Mission, implementation of the Agreement between the Government of the Russian Federation and the Government of Georgia on Cooperation in Economic Reconstruction and Rehabilitation in the Zone of Georgian-Ossetian Conflict and on Refugee Return of December 23 2000).

Resolution:

1 . Situation in the conflict zone

(Kusov On situation Kulakhmetov, Khaindrava, Chochiev, Keniaykin, Evnevitch)

1.1. The JCC members took note of the report of Major-General M.M. Kulakhmetov, JPKF Commander, about situation in the conflict zone (enclosed as Annex 1). However, the Georgian side disagreed with a number of the Commander’s evaluations and demanded well-grounded clarifications on respective issues (passed over to the Commander) to be provided.

The South Ossetian side expressed concern about the situation in and around the conflict zone (a list of claims was given over to the Georgian side).

1.2.The Georgian side within 10 days to resolve the issue of the military police unit of the Georgian Ministry of Defense currently deployed in the conflict zone, in compliance with the existing Regulation.

2. On establishment of a joint JCC working group to elaborate an agreed program for peaceful resolution of the Georgian-Ossetian conflict;

Resolution:

2.1. To set up a JCC Working Group to elaborate an agreed program for peaceful resolution of the Georgian-Ossetian conflict in view of the peace plan presented by the Georgian side and peaceful initiatives listed in the E. Kokoity’s letter of 12 December 2005.

2.2. The sides within 10 days to inform each other about their proposals about the composition of the Working Group, also before the next regular JCC meeting to prepare proposals for it Regulation.

2.3. Working group members, up to 10 people from each side, and its Regulation to be approved at the regular JCC meeting.

3. On trust building measures, security guarantees and demilitarization of the conflict zone.

The sides agreed to inform their leaders about the position of the head of the OSCE Mission to Georgia who expressed the following opinion:

- there is a sufficient level of agreement between the sides in the JCC format for starting joint negotiations and demilitarization of the conflict zone,

- in this context, at this moment there is a need for a transparent action plan and efficient monitoring of its implementation,

- the sides should consider different ways, possibly make a statement on non-use of force and provision of security guarantees.

4. On socio-economic rehabilitation of the conflict zone (in view of the completed Needs Assessment Mission, implementation of the Agreement between the Government of the Russian Federation and the Government of Georgia on Cooperation in Economic Reconstruction and Rehabilitation in the Zone of Georgian-Ossetian Conflict and on Refugee Return of December 23 2000).

Resolution:

4.1. To take note of the OSCE Mission to Georgia report about the results of their activities as part of the Needs Assessment concept for socioeconomic rehabilitation of the conflict zone.

4.2. In view of the sides’ comments on the OSCE Mission report, also taking into account principles recommended by the OSCE Mission (letter no. 2000307 of 23 March 2006), the Organizational Committee within a period of two weeks to prepare lists of the highest priority needs assessment projects to be approved at a JCC meeting.

4.3. To recommend the inter-governmental Russian-Georgian Commission on Economic Cooperation to consider at its nearest meeting issues pertaining to the implementation of the Agreement between the Government of the Russian Federation and the Government of Georgia on Cooperation in Economic Reconstruction and Rehabilitation in the Zone of Georgian-Ossetian Conflict and on Refugee Return of December 23 2000, including the establishment of a free economic zone.

4.4. The date and venue of the Organization Committee’s meeting to be decided as the work proceeds.

5. Miscellaneous

Resolution:

5.1. The next JCC meeting to be held in Tskhinvali, the date of the meeting to be identified as the work proceeds;

5.2. To take note of the Georgian side handing over to the JCC co-chairmen, also to representatives of OSCE and European Commission, a draft law on proprietary restitution and rehabilitation of victims of the Georgian-Ossetian conflict.

To instruct the JCC Ad-hoc Committee for Promotion of Voluntary Return of Refugees and Internally Displaced Persons resulting from the Georgian-Ossetian conflict to places of their former permanent residence to consider the draft law and give a respective expert evaluation. For this purpose, to hold a session of the JCC Ad-Hoc Committee within a period of two weeks.

5.3. For implementation of previously made decisions, taking into consideration readiness of the sides, to recommend holding an urgent meeting of the heads of law-enforcement bodies of the JCC sides, to discuss, inter alia, the issue of re-activating the SCC.

5.4. Georgian and South-Ossetian JCC Co-chairmen to inform each other about the results of considering earlier transferred claims of citizens.

5.5. The sides in the shortest possible terms to inform each other about the personal membership of the JCC units and JCC working bodies.
