REGULATIONS On the Joint Control Commission on settlement of the Georgian-Ossetian Conflict

The Joint Control Commission (JCC) has been created in compliance with the Agreement on principles of settlement of the Georgian-Ossetian Conflict of June 24, 1992 and its Protocols, in order to provide for control over the ceasefire, withdrawal of the armed units, dissolution of the defensive forces and provision for the regime of security in the conflict zone, as well to keep peace and inadmissibility of the restoring of hostilities, carrying out coordination of the joint activities of the Sides on stabilization of the situation, political settlement of the conflict and economic restoration of the damaged districts, return and settlement of refugees and IDPS.

1. The Joint Control Commission is a permanent body, comprised of the four sides, participating in the settlement of the conflict and liquidation of its consequences. The supreme organizational instance of The Joint Control Commission is a meeting of the plenipotentiary representatives of the Sides, represented by the heads of the Sides and other members of the JCC. Implementation of the decisions and recommendations of the JCC is carried out by its functional working groups.

2.  In The Joint Control Commission are included the special representatives of the ministries and institutions (on the credential of the Sides), assigned by the state bodies of the Sides, who are authorized to carry out coordinated decisions of the issues of broad scale settlement of the Georgian-Ossetian conflict.

3.  Functional working groups on major directions of the work of the JCC are headed by one of the members of the JCC with agreement of the side.

4.  In the work of the JCC takes part the Mission of the OSCE to Georgia.

5.  The are the following functions and tasks endowed on the Joint Control Commission:

a) Control over the implementation of agreements and contracts of the Sides on the settlement of the Georgian-Ossetian conflict, elaboration of the proposals and implementation of the specific measures for their realization;

b) Elaboration and organization of activities on creation of conditions for solution of the political, military, economic, humanitarian, information or other problems, also on coordinating of activities of the law Enforcement bodies of the Sides;

c) Facilitation to the further development of the dialogue and support to the political settlement of the conflict;

d) elaboration and implementation of the complex measures on return, reception and settlement of refugees (Internally Displaced Persons) with participation of the office of the UN High Commissioner for refugees (UNHCR);

e) Discussion and pragmatic solution of the issue on economic restoration of the districts in the zone of the Georgian-Ossetian conflict;

f) Organization of control over the protection of Human Rights and Rights of National Minorities in the conflict zone.                                                           

6.  The JCC creates working groups with participation of the respective representative-specialists for the implementation of the above-mentioned functions and solution of tasks on the following major directions of work:

- On Political issues;

- On peace keeping, security and strengthening of public order;

- On issues of economic restoration of the districts in the Georgian-Ossetian conflict zone;

- On issues of humanitarian assistance to the population and organized return of refugees (IDPs) to the places of their permanent settlement;

 -  On other issues, based on necessity.

7.  The working groups carry out work on preparation of analytical materials, drafts of the decisions of the JCC on holding talks on issues, referring to their competence.

In case of necessity they are entitled to attract to their work experts on specific issues, demand and receive necessary information from the respective state bodies and institutions.

8. Conclusions and proposals of the working groups are discussed on the meetings of the JCC for adoption of final decisions.

9.  In the Competences of the Joint Control Commission is the coordination of activities of the peacekeeping forces and of the observers, appointed by the Sides. JCC keeps permanent ties with the peacekeeping forces, deployed in the conflict zone and takes decisions on their further utilization.

10.  The Commandment of the peacekeeping forces, on the basis mandate of agreement on principles of settlement of the Georgian-Ossetian conflict and the protocols to it, elaborates and implements the necessary measures on peacekeeping and observation of public order, inadmissibility of restoration of hostilities, disarmament of illegal armed units and introduces in a regulated manner, the proposals about speedy utilization and improvement of organization of peacekeeping forces in the conflict zone.

11.  The Joint Control Commission coordinates its activities with the joint management body for the solution of the issue of funding, logistics supplies and organization of the construction of objects, created in compliance with agreement between the Government of the Russian federation and the Government of Georgia on economic restoration of districts in the zone of the Georgian-Ossetian conflict of September 14, 1993 and protocol of agreement attached to it.

12.  The Joint Control Commission discusses and assesses the situation, created in the zone of the Georgian-Ossetian conflict on the basis of the data, which, on its request, are submitted by the competent bodies of the Sides.

13.  The JCC, with a goal to objectively inform the society, submits to the means of Mass media materials on the process of settlement through multi-lateral center at the JCC.

14.  The members of the JCC enjoy diplomatic immunity and privileges in accordance with the norms of the International Law.

15.  The members of the JCC are entitled to free movement on the territory of the conflict zone. The representatives of the sides in places demonstrate support to the members of the JCC and are responsible for their safety.

16.  The official location of the Joint Control Commission is city of Tskhinvali. In case of necessity plenary sessions of the JCC on the agreement of the Sides can be organized in other places.

17.  The meetings of the JCC take place on the basis of need but not fewer than once in two months. One of the heads of the sides’ representations is chairing the meeting, in accordance with mutual agreement. The decisions of the JCC are taken on the basis of the consensus among the sides.

18.  For conducting of organizational work and supporting speedy communications among the sides, at the JCC is created the secretariat with the permanent dislocation in the city of Tskhinvali.

The structure, funding and staff of the secretariat are approved by the Joint Control Commission.

19. Funding of the Joint Control Commission and its working bodies and services are implemented by the Russian federation and the Republic of Georgia on equal basis.

20. The working language of the Joint Control Commission and the language of its documents is Russian language.

21. The Joint Control Commission stops it activities after the achievement of the broad-scale settlement of the Georgian-Ossetian conflict.
