APPEAL TO THE PRESIDENT OF THE USSR M. S. GORBACHEV

            On 12 December 1990 the Supreme Council of the Republic of Georgia adopted the Resolution on Introducing the State of Emergency and the Curfew on the Territory of Tskhinvali and the Java District of the Soviet Republic of South Ossetia.  Introduction of such state was based on the alleged criminal acts of the separatist forces, anti-constitutional elections, usurpation of power by the fraudulent elements and terrorist acts on the territory of the Soviet Republic of South Ossetia.

            However, the developments in South Ossetia reflect the democratic reforms, which take place in the Soviet Union.  However, it did not serve as a ground in other Union Republics for introducing the state of emergency.

            Introduction of the state of emergency on the territory of South Ossetia is a result of anti-popular strategy followed by the Supreme Council of the Republic of Georgia, which strives to expel all “non-aborigines” nations from the territory of Georgia.

            Adoption of this Resolution have made more intensive the actions of the extremist population of Georgian villages: still they block the movement, brutally beat non-Georgian nationals, confiscate private vehicles and property, resort irregular shootings and terrorize the Ossetian part of the population.

            Adoption of the Resolution by the Supreme Council of the Republic of Georgia on introducing the state of emergency runs counter to articles 1, 6(2) and 11 of the Union Law on Distribution of Competences between the Subjects of the Federation.

            Let us state that without prompt reaction from the side of the President of the USSR the situation may be destabilized on the territory of South Ossetia, followed by unpredictable consequences.

            Based on the aforementioned we ask to the President of the USSR:

            1.  To declare null and void the Resolution of the Supreme Council of the Republic of Georgia.

            2.  To introduce the state of emergency under the Decree of the President of the USSR on the territory of South Ossetia through the internal troops of the USSR for securing the lawfulness, order and the Soviet power.

            Adopted at the first session of the People’s Deputies of the Soviet Republic of South Ossetia of the first convocation.
