AGREEMENT BETWEEN THE GOVERNEMNT OF THE REPUBLIC OF GEORGIA AND THE GOVERNMENT OF THE RUSSIAN FEDERATION on check-points across the Customs’ border 

The Government of the Republic of Georgia and the Government of the Russian Federation,

guided by the aspiration to improve cooperation in the domain of forwarding across the Customs’ borders and to increase the capacity of the check-points,

aspiring to create the appropriate conditions for crossing of Customs’ border by persons, transportation means and goods,

Have agreed on the following:

           

Article 1

1. The sides will open on the Customs’ border between the Republic of Georgia and the Russian Federation the following check-points:

1) Railway:

a) “Gantiadi” (Georgia) – “Adler” (Russia)

2) Road transportation:

a)  “Gantiadi” (Georgia) – “Adler” (Russia)

b)  “Roki” (Georgia) – “Nizhni Zaramag” (Russia)

c) “Kazbegi” (Georgia) – “Verkhni Lars”) Russia)

Air and marine transportation, exchange of international post between the Republic of Georgia and the Russian Federation are carried out through airports and sea ports, which are open as international check-points. Places and points of the international post exchange are regulated in accordance with international agreements; the Sides are the parties to them and also in accordance with the domestic legislation of the Sides.

2.  The check-points across the Customs’ border, mentioned in the article 1 of the present document, will be opened also for the crossing of borders by the persons, transport means and the goods of the third countries.

3.   Permitting of persons, transport means and goods across the check-points, including those in the airports and sea ports, are carried out in compliance with the acting legislation of the each Side.

4.   Crossing of the Customs’ borders by persons across the automobile check-points is carried out either by transportation means or on foot.

5.  Timeline of opening the check-points at the Customs’ border and all the types of communication, carried out through these check-points the Sides will define by exchange of Notes after the completion of their arrangement and establishment of necessary infrastructure.

 

Article 2

            1. Till opening of the check-points at the Customs’ border, which are defined in the paragraph 1, Article 1, each Side prepares on its territory the respective infrastructure, taking into account the prospects of increasing of transport means, goods and also persons, amongst other, crossing the border on foot.   

            2. Assignment on creating and drafting of buildings at check-point objects of each automobile and railway check-point is agreed by eh competent bodies of the both sides.

 

 

 

Article 3

The competent bodies of the Sides shall comprehensively cooperate on the issues of improvement of communication across the Customs’ border, best cooperation of existing and opening of new, comfortably dislocated check-points for the international communication. During the realization of these tasks there will be observed the provisions of Article 2.

 

Article 4

 Opening and closing of the check-points across the Customs’ border is carried out on the basis of the mutual agreements.

 

Article 5

1. Suspension or restriction of movement across the Customs’ border in the separate Check-points can be introduced due to sanitary reasons, interests of public safety or as a consequence of natural catastrophes. The side, aspiring to suspend or to restrict the movement, informs about this the other side, not later than five days before the planned suspension or restriction.

2. In the emergency situation, notification, meant in paragraph 1 of the article shall be carried out not later than 24 hours before the planned suspension of movement.

3. On suspension or restriction of movement across the Customs’ border in relation with repairing of objects of the objects of check-points or communication facilities, the sides shall inform each other not later than three months before the start of such work, and shall also inform about the date of the works completion.

 

Article 6

The Sides on mutual agreement can, in justified cases, while observing the respective of requirements and control, permit the crossing of the Customs’ border out of the acting check-point.                               

 

Article 7        

The present agreement is enforced from the date of its signature and shall act during 5 years with automatic prolongation for the next five year periods, if neither of the Sides notifies in written form the other side about its desire to suspend the action of this agreement 6 months prior to the expiration of the term of the respective period.

            Concluded in Moscow, October 8, 1993, in two copies, each of them in the Georgian and the Russian languages and the both texts are authentic.
