THE LAW OF THE REPUBLIC OF GEORGIA on introducing the position of the President of the Republic of Georgia and changes and amendments to the Constitution of the Republic of Georgia with this regard

In order to develop the state arrangement of the Republic of Georgia and country’s sovereignty, to strengthen the citizens’ rights, freedoms and security, the Supreme council of the Republic of Georgia decrees:

I.  To introduce the position of the President of the Republic of Georgia.

II. In view of introduction of the position of the President of the Republic of Georgia the following changes and amendments shall be introduced to the Constitution of the Republic of Georgia:

Article 1214.  The President of the Republic of Georgia:

(…)

9) (shall) appoint and dismiss the prefect with the consent of the Government of the Republic of Georgia and the Council of Ministers of the autonomous republics.

10) (shall) sign the laws of the Republic of Georgia;  (shall be entitled) to return the law to the Supreme Council of the Republic of Georgia or to the Supreme Council of the autonomous republics with his/her controversial remarks, for reconsideration and voting.  If the Supreme Council of the Republic of Georgia confirms its previous resolution by 2/3 of votes, the President of the Republic of Georgia shall sign the law and pass it for the referendum;

13) (shall be authorised) to abrogate orders and ordinances of the Government of the Republic of Georgia, the acts of the ministries and other subordinate agencies, the decrees of the Prefects; suspend the orders and ordinances of the council of ministers of the autonomous republic, also to raise the issue before the Supreme Council on suspension of the law of the autonomous republic and the Decree of the Supreme Council if they are in contradiction with the Constitution of Georgia and laws;

19.  To word para 2 of Article 146 as follows:

“The prefect is accountable before the Supreme Council of the Republic of Georgia, the President of the Republic of Georgia, the Government of the Republic of Georgia; and Gemgeoba and Gamgebeli – before the relevant Sakrebulo and the Prefect”.

IV. This law shall come into effect upon its promulgation.
