DECISION OF THE FIRST SESSION OF THE SUPREME COUNCIL OF THE SOUTH OSSETIAN SOVIET REPUBLIC on recognition as null and void of the Law of the Supreme Council of the Republic of Georgia “On Abolishing the South Ossetian Autonomous Oblast”

On 11 December 1990 the Supreme Council of the Republic of Georgia adopted the law “On Abolishing the South Ossetian Oblast”.  Adoption of this kind of law runs counter to Article 73(1) and  Article 87 of the Constitution of the USSR and the law of the USSR of 26 April 1990 “On Separation of Powers between the Center and the Subjects of Federation”.

Falsification of historical processes developed in South Ossetia and in Georgia in 1920s laid the ground to the abolishment of Autonomy.  Reference to para 3 and 11 of Article 113 of the aforementioned law have no ground as they have been abolished before by the Decrees of the Supreme Council of the GSSR.

In this connection the Session of the Supreme Council of the South Ossetian Soviet Republic decides:

To recognize null and void the law of the Supreme Council of the Republic of Georgia “On Abolishing the South Ossetian Oblast” and ask the VI Congress of the People’s Deputies for considering and deciding the said issue.

Given the fact that 72% of electorate took part in the elections of the Supreme Council of the Republic of South Ossetia, it is necessary to ask the Congress of the People’s Deputies of the USSR for approving the Decision on reforming the South Ossetian Autonomous Oblast into the Soviet republic of South Ossetia on the basis of para 1 Article 73 of the Constitution of the USSR and the law of the USSR “On Separation of Powers between the Center and the Subjects of Federation”

To ask the VI Congress of the People’s Deputies of the USSR to recognize the Soviet Republic of South Ossetia as a subject of Federation and as the signatory of the new Union Treaty.

The Supreme Council of the Soviet Republic of South Ossetia calls upon the all people’s deputies to support the given Decision.
